Decolonizing Time: Work, Leisure, and Freedom demonstrates the importance of time as a central category for political theory. The historical struggle over the control of time is of analytical, moral, and practical significance, such that any project aiming to establish a meaningful relationship between freedom and equality must begin by reconceptualizing time. Whereas the labor movement's original fight for time sought to limit the length of the working day, the fight for time today must address the new realities of the (...) colonization of time, which increasingly extends beyond work to free time and leisure. Decolonizing Time reconsiders discretionary time as a measure of freedom through the concept of temporal autonomy as developed through the Aristotelian-Marxist, critical, and feminist theory traditions. Two important criticisms of contemporary liberalism turn to Aristotle's political thought for support that which advocates participatory democracy, and that sympathetic to the rule of a virtuous or philosophic elite. In this commentary on Aristotle's politics the author explores how Aristotle offers political rule as an alternative to both the rule of aristocratic virtue and an unchecked participatory democracy. In this book, Mary P. Nichols argues for the centrality of the idea of freedom in Thucydides' thought.

Scholars have recently argued that in the Symposium Plato is critical of Socrates and falls closer than his philosophic spokesman to the side of poetry in the old quarrel between philosophy and poetry. Contrary to such interpretations, I argue that on the basis of his experience of a philosophic life, Socrates responds to the poets Plato presents in that dialogue, offering a superior understanding not only of Love but of poetry itself. Far from self-sufficient, but like Love “dwell[ing] always in (...) need” and generating through teaching, Socrates both requires and supports political life. The state between poverty and resource that accounts for the pursuit of wisdom and its self-generation through questioning others also accounts for the ongoing human activities that keep political communities alive and flourishing. At issue is not simply Plato’s attitude toward Socrates, but the very nature of philosophy and its relation to the political community. (shrink)

This book takes a fresh look at Socrates as he appeared to three ancient writers: Aristophanes, who attacked him for his theoretical studies; Plato, who immortalized him in his dialogues; and Aristotle, who criticized his political views. It addresses the questions of the interrelation of politics and philosophy by looking at Aristophanes' Clouds, Plato's Republic, and Book II of Aristotle's Politics--three sides of a debate on the value of Socrates' philosophic life. Mary Nichols first discusses the relation between Aristophanes and (...) Plato, showing that the city as Socrates' place of activity in the Republic resembles the philosophic thinktank mocked in Aristophanes' Clouds. By representing the extremes of the Republic's city, Plato shows that the dangers attributed by Aristophanes to the city are actually inherent in political life itself. They were to be moderated by Socratic political philosophy rather than Aristophanean comedy. Nichols concludes by showing how Aristotle addressed the question at issue between Plato and Aristophanes when he founded his political science. Judging Plato's and Aristophanes' positions as partial, Nichols argues that Aristotle based his political science on the necessity to philosophy of political involvement and the necessity to politics of philosophical thought. In order to better understand the meaning of Socrates’ philosophic life, Nichols explores the theme of caring that is prominent in Socrates’ Apology. What is the relation between the examined life that he says is the only one worth living for a human being and the care he claims and shows for others, especially the young of Athens? Nichols discusses Socrates’ illustrations of philosophic caretaking from the Symposium, Phaedrus, and Theaetetus, both his own caretaking activities as well as his teachings (...) about love and generation, the art of words, and midwifery. Finally, she argues that the god who “commands” an answer to his oracular riddle, as Socrates interprets it in the Apology, serves as a model for the union of questioning and caretaking central to Socrates' life of philosophizing. In this article, I set out a theoretical framework for analyzing fictional copyright protection of fictional characters in literature. Using this framework, I argue that the two most prominent approaches that U.S. courts have adopted with respect to fictional character copyright (the Nichols test and the Sam Spade “Story Being Told” test) are unsustainable. The idea of distinct delineation that came out of Nichols may be understood in two ways: on one view, fictional characters are distinctly delineated if they deviate (...) from a literary type. On the other view, they are distinctly delineated if they are attributed a sufficient number of properties in the fictions where they appear. Both views succumb to serious objections, while the test in Sam Spade is no better. The failure of the two judicial tests suggests that, instead of asking questions about fictional character copyrightability, courts should instead focus on the substantial similarity question. In the last part of the paper, I draw a distinction between two types of fictional character copyright infringement cases (transformations and transfers), and suggest that a Nichols-type substantial similarity analysis is all that is required in transformation situations. Although the focus of this article is U.S. law, the issues discussed and the analyses proposed may prove helpful in addressing fictional copyright in other jurisdictions as well. (shrink)

Sentimental Rules is an ambitious and highly interdisciplinary work, which proposes and defends a new theory about the nature and evolution of moral judgment. In it, philosopher Shaun Nichols develops the theory that emotions play a critical role in both the psychological and the cultural underpinnings of basic moral judgment. Nichols argues that our norms prohibiting the harming of others are fundamentally associated with our emotional responses to those harms, and that such 'sentimental rules' enjoy an advantage in cultural evolution, (...) which partly explains the success of certain moral norms. This has sweeping and exciting implications for philosophical ethics. Nichols builds on an explosion of recent intriguing experimental work in psychology on our capacity for moral judgment and shows how this empirical work has broad import for enduring philosophical problems. The result is an account that illuminates fundamental questions about the character of moral emotions and the role of sentiment and reason in how we make our moral judgments. Thus, the historical particulars of the New Testament events are not random and coincidental, but they connect perfectly within God's plan.In terms of biblical events, then, what are the significances of the time periods during which, and places at which, they occurred? "Why was Jesus born on a particular date, at a particular time, and in a particular manger in Bethlehem? Why was the womb of Mary, Mater Dei, chosen at that exact time, and at that exact place? Williams (1970) argues that our intuitions about personal identity vary depending on how a given thought experiment is framed. Some frames lead us to think that persistence of self requires persistence of one's psychological characteristics; other frames lead us to think that the self persists even after the loss of one's distinctive psychological characteristics. The current paper takes an empirical approach to these issues. We find that framing does affect whether or not people judge that persistence of psychological characteristics is (...) required for persistence of self. Open-ended, abstract questions about what is required for survival tend to elicit responses that appeal to the importance of psychological characteristics. This emphasis on psychological characteristics is largely preserved even when participants are exposed to a concrete case that yields conflicting intuitions over whether memory must be preserved in order for a person to persist. Insofar as our philosophical theory of personal identity should be based on our intuitions, the results provide some support for the view that psychological characteristics really are critical for persistence of self. Investigating instances where lexical selection fails can lead to deeper insights into the cognitive machinery and architecture supporting successful word retrieval and speech production. In this paper, we used a multiplex lexical network approach that combines semantic and phonological similarities among words to model the structure of the mental lexicon. Network measures at different levels of analysis (degree, network distance, and closeness centrality) were used to investigate the influence of network structure on picture naming accuracy and errors by people with (...) Anomic, Broca's, Conduction, and Wernicke's aphasia. Our results reveal that word retrieval is influenced by the multiplex lexical network structure in at least two ways—(a) the accuracy of production and error type on incorrect productions were influenced by the degree and closeness centrality of the target word, and (b) error type also varied in terms of network distance between the target word and produced error word. Taken together, the analyses demonstrate that network science techniques, particularly the use of the multiplex lexical network to simultaneously represent semantic and phonological relationships among words, reveal how the structure of the mental lexicon influences language processes beyond traditionally examined psycholinguistic variables. We propose a framework for how the multiplex lexical network approach allows for understanding the influence of mental lexicon structure on word retrieval processes, with an eye toward a better understanding of the nature of clinical impairments, like aphasia. The precautionary principle has been widely discussed in the academic, legal, and policy arenas. This paper argues, however, that there is no single precautionary principle and we should stop referring to ?the? precautionary principle. Instead, we should talk about ?precaution? and ?precautionary approaches? more generally and identify and defend distinct precautionary principles of limited scope. Drawing on the vast literature on ?the? precautionary principle, this paper further argues that the challenges of decision making under conditions of uncertainty necessitate taking a (...) precautionary approach to decision making that will enable us to understand what particular precautionary principles require of us on a case-by-case basis. According to recent accounts of the imagination, mental mechanisms that can take input from both imagining and from believing will process imagination‐based inputs (pretense representations) and isomorphic beliefs in much the same way. That is, such a mechanism should produce similar outputs whether its input is the belief that p or the pretense representation that p. Unfortunately, there seem to be clear counterexamples to this hypothesis, for in many cases, imagining that p and believing that p have quite different psychological (...) consequences.
